TK Teepees Hire Agreement

Parties to this Agreement
This Hire Agreement is between TK Teepees ("the Business") and the client named on the invoice ("the Hirer").

By proceeding with payment to the Business, the Hirer confirms they have read, understood, and accepted the comprehensive terms and conditions of the TK Teepees Hire Agreement and agree to be bound by the terms and conditions for the hire and use of TK Teepees equipment and services. 1. Definitions

- "The Business" refers to TK Teepees.

- "The Hirer" refers to the individual or entity booking the equipment.

- "The Equipment" refers to the items hired as specified in the booking agreement.

- "The Agreement" refers to this Hire Agreement between the Business and the Hirer.

2. Responsibilities of the Hirer

2.1 Guest Supervision and Safety

The Hirer is responsible for ensuring the safety of all guests during the hire period. This includes providing adequate supervision and taking all reasonable steps to prevent injury.

2.2 Proper Use of Equipment

The Equipment is to be used solely for its intended purposes—sitting, dining, sleeping, or engaging in pamper party activities (including facial treatments, foot and hand soaks, manicures, and pedicures). Activities such as climbing, jumping, hanging, bouncing, running, standing on, or any other misuse of the Equipment are strictly prohibited and may result in injury or damage. The Hirer agrees to supervise all guests to ensure compliance with these guidelines at all times.

The Business accepts no liability for injury, loss, or damage arising directly or indirectly from the improper or unauthorised use of the Equipment. All use is at the risk of the Hirer, who assumes full responsibility for the conduct and supervision of all participants throughout the hire period.

2.3 Maintenance of Equipment

The Hirer must ensure that all Equipment remains in its original condition throughout the hire period. Reasonable steps must be taken to prevent damage, misuse, or excessive soiling of the Equipment, and to ensure it is ready for collection at the agreed-upon time in the same condition as hired.

All Equipment is supplied by the Business in clean, safe, and fully operational condition at the commencement of hire. The Hirer accepts full responsibility for the Equipment from the time of delivery or pick up until the time of collection or drop off. Liability for any loss, damage, injury, or misuse during the hire period rests solely with the Hirer. The Business shall not be held liable for any direct or indirect claims arising from the use or condition of the Equipment once delivered or collected and accepted by the Hirer.

2.4 Condition Verification and Proof of Supply
The Business may, at its discretion, take time-stamped photographs of the Equipment at the time of delivery and/or set-up to confirm the condition and completeness of items supplied. These records may be used as evidence in the event of a dispute regarding damage or missing items. The Hirer is encouraged to inspect the Equipment upon delivery and must raise any concerns immediately. Failure to do so constitutes acceptance that all Equipment was received in good working order and condition.

2.5 DIY Collection, Transport and Return
Where the Hirer opts to collect and/or return Equipment (DIY hire), they accept full responsibility for the safe handling, transport, and protection of the Equipment from the time it leaves the Business's possession until it is returned and accepted by the Business. The Business shall not be held liable for any damage, loss, injury, or accident that occurs during transit in the Hirer’s vehicle or other chosen mode of transport. It is the Hirer's responsibility to ensure their vehicle is suitable for the safe transport of all items, and that Equipment is securely loaded and protected from weather, impact, or other risks.

3. Ownership and Care of Equipment

3.1 Retention of Ownership

All rented Equipment always remains the property of TK Teepees.

3.2 Liability for Damage or Loss

The Hirer is responsible for any damage, loss, or breakages of Equipment, including but not limited to strong odours, stains, soiled or torn tents, bedding, décor packages, or failure to follow provided instructions. The Hirer agrees to pay for the replacement or repair of such items within 7 days of receiving an invoice. This may also result in the forfeiture of any bond paid.

3.3 Damage During Installation

The Business will be responsible for any damage caused during the installation of Equipment. However, any damage occurring after installation is the responsibility of the Hirer.

3.4 Substitution of Equipment

The Business reserves the right to substitute rented Equipment with items of similar value and type without prior notice, should unforeseen circumstances arise, such as loss, damage, or inventory shortages.

4. Age Restrictions and Supervision

4.1 Age Requirements

The Equipment is designed for use by individuals aged 4 years and older. The Hirer must ensure that all children are always supervised while using the Equipment. Children must not be left unsupervised overnight in the rented Equipment. The Hirer is responsible for obtaining permission from the parents or legal guardians of any children using or left overnight in the Equipment.

4.2 Allergen Notification

The Business is not responsible for allergen-related issues. The Hirer must inform the Business in writing of any guest allergies to Equipment or products prior to the event. This includes, but is not limited to, spa party products, bell tents, picnic setups, and teepee parties. For spa parties, the Hirer should request a product sheet to review ingredients before use.

5. Smoke-Free Environment

5.1 Smoking, Vaping, and Substance Use

The Hirer agrees that the setup location for TK Teepees will be, and will remain, free from smoking, vaping, and the use of any other substances, including but not limited to tobacco and e-cigarettes. The Business strictly prohibits the use of such substances near the Equipment due to fire hazards and to prevent odour contamination. If the Equipment is returned having been exposed to such environments, the Business reserves the right to withhold the bond and invoice the Hirer for cleaning or replacement costs, payable within 7 days.

5.2 Damage Due to Substance Exposure

If any Equipment is damaged due to exposure to smoking, vaping, or other substances, the Hirer will be liable for the full replacement cost. Replacement fees may be up to $1,600 for items such as bell tents, with other prices available upon request. The Hirer agrees to pay for damages in full within 7 days of receiving an invoice.

6. Equipment Care and Usage Restrictions

6.1 Prohibited Items and Activities

- Footwear and Sharp Objects: All shoes and sharp objects should be removed prior to using the Equipment.

- Pets: The Hirer is requested to refrain from allowing pets on or in the Equipment. Should the Equipment require extensive cleaning due to pet hair, the Hirer will be invoiced for cleaning or replacement costs, payable within 7 days.

- Stains and Damage Prevention: To avoid stains that cannot be removed, the following guidelines must be observed:

- Ensure any recently applied nail polish is completely dry before entering the Equipment.

- Do not consume wet dishes, curries, oily or greasy foods, tomato-based foods, or drinks other than plain water on or near sleeping Equipment.

- Ensure children remove makeup before using the Equipment.

- Do not use pens, paints, crayons, markers, playdough, or glow sticks in or around the Equipment.

7. Delivery and Setup

7.1 Access and Site Preparation

The Hirer must ensure there is adequate space for the required tents and suitable access and parking for delivery and setup. A site inspection by TK Teepees can be arranged prior to the event if necessary.

7.2 Preparation

The Hirer must ensure the setup area is clear of all furniture or equipment and clean before TK Teepees' arrival. Delays in preparation may result in incomplete setup, as multiple bookings are scheduled, and adherence to booking times is essential.

7.3 Access Safety

The Hirer must ensure that access routes for moving Equipment in and out of the event are safe to prevent injury to staff.

8. Weather Conditions

8.1 Bell Tent Usage

For bell tent hires, weather conditions will be assessed closer to the event date. While weatherproof, the bell tent will not be used in inclement weather conditions (e.g., heavy rain, high winds, or extreme heat) for safety reasons. The Business will notify the Hirer prior to the event if alternative arrangements are necessary. If adverse weather develops during the event, the Hirer is responsible for protecting items inside the tent from potential damage.

9. Spa and Picnic Parties

9.1 Spa Party Allergies

For spa parties, with or without an attendant, the Hirer is responsible for checking with all guests regarding allergies. The Hirer should request a product ingredients sheet from TK Teepees and consult with all guests or their parents/legal guardians (if under 18) to identify any allergies to spa products. Any known allergies should be documented and communicated to the Business in writing prior to the event.

9.2 Picnic Party Equipment Care

For picnic parties, the Hirer must ensure that all plates, glasses, and cutlery are washed with hot soapy water, dried, and packed into the provided travel boxes. If the event is in a public space, cleaning wipes will be provided to remove food

10. DIY and / or TK TEEPEES Staff set, run, pack down Parties

Whether the Equipment is part of a DIY hire or a party setup provided by TK Teepees staff, the Hirer is fully responsible for ensuring compliance with all terms and conditions outlined in this Agreement. This includes, but is not limited to, safe use, supervision, care of the equipment, use as intended for hire and adherence to allergen, safety, and environmental guidelines.
